They are not.
The Supreme Court decides what an "official act" is, and they most certainly will not decide a democratic president acts as "official."

I’d take a term of Mitt Romney over Trump. At least he
- had respect for the office
- could articulate sentences in a clear manor
- had a plan, and could explain it
- wasn’t a convicted felon/rapist
- had decorum in discourse/debates
